ANJALI SHRIRANG JOGLEKARversusTHE ADDITIONAL COLLECTOR PALGHAR

Decided
Disposal
Disposed Off

Holding

The Court set aside both the Collector’s and the SDO’s orders and remitted the matter to the SDO for fresh consideration, permitting the petitioner to intervene.

Summary

Anjali Shrirang Joglekhar filed a writ petition challenging a review order dated 7 December 2023 issued by the District Collector, Palghar, and an earlier order dated 23 December 2022 issued by the Sub‑Divisional Officer (SDO), Palghar. The parties agreed before the bench that both the Collector’s and the SDO’s orders should be set aside and the matter remitted to the SDO for fresh consideration. The Court accordingly set aside the impugned orders, directed the SDO to restore the earlier proceedings, and allowed the petitioner to intervene as a party since any further order would affect her rights. The Court also left the question of jurisdiction to entertain the review open. The writ petition was thereafter disposed.

Issues considered

  • Whether the District Collector had jurisdiction to entertain the review petition.
  • Whether the order of the Sub‑Divisional Officer dated 23 December 2022 should be set aside.
  • Whether the petitioner can be permitted to intervene and be made a party to the SDO proceedings.
