Decided

Holding

The Court directed the State to decide the pending revision application within four weeks and disposed of the petition.

Summary

The petitioners, represented by Kiran Karbhu Thorat and others, sought a writ of mandamus directing the State of Maharashtra to hear and decide Revision Application No. 755 of 2025 pending before the Minister of Revenue and Forest Department within four weeks, and also asked for an interim stay of an order dated 03‑03‑2025 issued by the Divisional Commissioner, Nashik. The petitioners limited their relief to the time‑bound direction for the revision. The Court observed that a statutory revision was pending before the Minister and emphasized the need for an expeditious decision without undue delay. Accordingly, the Court directed the respondent to decide the pending revision within four weeks and disposed of the writ petition, without granting the interim stay. The order reflects the Court’s willingness to issue mandamus to ensure timely administrative action.

Issues considered

  • Whether the High Court can issue a writ of mandamus directing the Minister to decide a pending statutory revision within a specified time.
  • Whether an interim stay of the order dated 03‑03‑2025 should be granted pending the outcome of the writ petition.

Subjects

  • writ of mandamus
  • revision application
  • administrative law
  • expeditious decision
  • interim stay
