SANGITA SHRIMANT KALE ALIAS SANGITA VIRENDRA PATIL AND ANOTHERversusTHE STATE OF MAHARASHTRA THR SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition is allowed; the petitioner must be treated as a PAP candidate for the TAIT 2025 recruitment.

Summary

The petitioner, Sangita Shrimant Kale (alias Sangita Virendra Patil), filed a writ petition seeking recognition as a Physically Handicapped (PAP) candidate for the TAIT 2025 recruitment process. The State of Maharashtra opposed, questioning the validity of the PAP certificate dated 18/09/2025. The Court noted that the matter was directly governed by its earlier decision in Writ Petition No.4880/2026 (Shri Vivek Vishnu More v. State of Maharashtra). Relying on the reasoning in that precedent, the Court held that the petitioner is entitled to be treated as a PAP candidate. Consequently, the writ petition was allowed and the respondents were directed to recognize the petitioner as a PAP candidate for the ongoing recruitment.

Issues considered

  • Whether the petitioner qualifies as a Physically Handicapped (PAP) candidate for the TAIT 2025 recruitment.
  • Whether the State must recognize the PAP certificate issued on 18/09/2025.
