SHAIKH MUSTAK SHAIKH AMIRversusTHE STATE OF MAHARASHTRA AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The petition stands disposed as the "A" Summary report has already been filed before the court.
Summary
The petitioner filed a criminal writ petition seeking the completion of investigation, filing of a charge-sheet, and arrest of the accused in FIR No.137/2023 of Jalna Taluka Police Station. The respondent's Additional Public Prosecutor submitted a communication dated 18.08.2026 indicating that an "A" Summary report had already been filed before the concerned court. The bench considered whether the petitioner could still challenge the filing of the summary report. It held that since the summary had been filed, the petition to compel further investigation and filing of a charge-sheet could not proceed. Consequently, the petition was disposed of.
Issues considered
- Whether the petitioner is entitled to a direction for completion of investigation, filing of charge-sheet, and arrest of the accused under the FIR.
- Whether the petitioner can challenge the filing of an "A" Summary report before the court.
