Petitioners who satisfied the six‑month service condition are entitled to pension recalculated on their actual last drawn salary with the annual increment, and arrears must be paid within ninety days without interest.
Summary
A large number of writ petitions filed by former government employees sought enhanced pensionary benefits. The petitioners claimed they were entitled to the difference between the pension calculated on their actual last drawn salary, including the annual increment, and the pension awarded by the State. The Court observed that the matter had already been decided in Writ Petition No.15662/2025 and applied the same principles. It held that petitioners who had rendered at least six months of service in the last year before superannuation are eligible for the recalculated pension and any arrears, which must be paid within ninety days. However, because many petitions were filed belatedly, the Court denied any claim for interest on the arrears. Consequently, the petitions were partly allowed with the directions specified.
Issues considered
- Whether former employees are entitled to pension calculated on the actual last drawn salary including the annual increment
- Whether a minimum service period of six months in the last year before superannuation is required for entitlement
- Whether interest is payable on arrears when petitions are filed after a delay

CORAM : NITIN B. SURYAWANSHI AND
ABASAHEB D. SHINDE, JJ.
DATE : 11th AUGUST, 2026
PER COURT :
1. The issue raised in these petitions is squarely covered
by the decision of this Court at Principal Seat [Coram : Ravindra V.
Ghuge and Abhay J. Mantri, JJ.] dated 18/03/2026, passed in Writ
Petition No.15662/2025.
2. For the reasons stated in the said order, the writ
SVH
5 36-WP-9483-26.odt
petitions are partly allowed with following directions:
(a) The petitioners would be entitled for monetary benefits /
difference of pensionary benefits as per the actuals w.e.f.
from their respective dates of superannuation, provided they
have worked for 6 months or more in the last year up to their
superannuation.
(b) The pensionary benefits of the petitioners would be
recalculated by including the annual increment in their last
drawn salary prior to their superannuation and such
recalculated pensionary benefits shall be payable to them.
(c) Arrears if any, shall be paid to them within a period of 90
days. Many of the petitioners have approached belatedly
before this Court and, therefore, akin to the orders passed in
several matters, they would be not entitled for the interest
component.
