Disposal
26-DISMISSED @ ADM.STAGE
Bench
C DOSHI

Holding

The court granted a final adjournment until 23 March 2026, after which the petition will be dismissed if the petitioner fails to appear.

Summary

The petitioner was previously directed to serve the unserved respondents and failed to do so. During the first hearing, the petitioner’s counsel requested a continuance to the second session, but the counsel was absent when the matter was called. The court, noting the repeated delay and absence, granted a final opportunity to comply by 23 March 2026, warning that failure to appear would result in dismissal of the petition. The matter was listed for a further hearing on 27 March 2026. No substantive merits of the underlying dispute were addressed; the order dealt solely with procedural compliance.

Issues considered

  • Whether the court should grant another adjournment for the petitioner to serve the unserved respondents
  • Whether failure to appear after the granted adjournment warrants dismissal of the petition
