The court held that the 16‑day delay was condonable and allowed the application.
Summary
The applicants filed a Miscellaneous Civil Application seeking condonation of a 16‑day delay in filing a review petition against an order dated 28‑Nov‑2025 in Special Civil Application No. 270 of 2025. The respondents opposed the condonation, arguing that the delay was unexplained. The court examined the averments made in the condonation application and found them satisfactory. No substantive merits of the review were considered, as the application pertained solely to procedural delay. Consequently, the court allowed the condonation, permitting the review application to proceed. The civil application was thereafter disposed of.
Issues considered
- Whether a delay of 16 days in filing a review application can be condoned under the procedural rules of the High Court.
