The bail application is withdrawn and the trial court is directed to expedite the trial.
Summary
The petitioner, an under‑trial prisoner, filed a regular bail application after the filing of the chargesheet. During the hearing, the petitioner’s counsel sought permission to withdraw the bail application and requested that the trial court be directed to expedite the trial. The Court, not inclined to examine the merits of the bail application, granted the request to withdraw the application. The application was disposed of as withdrawn, and the Court specifically directed the trial court to speed up the trial proceedings. No substantive discussion on the merits of bail was undertaken.
Issues considered
- Whether a regular bail application filed after the chargesheet may be withdrawn at the request of the applicant.
- Whether the trial court can be directed by the High Court to expedite the trial of an under‑trial prisoner.
