The Court allowed the withdrawal of the regular bail application and disposed of it as withdrawn, without examining its merits.
Summary
The petitioner, Tejpalsingh Prabhusinh Rana, filed a regular bail application before the filing of a charge-sheet. During the hearing, the petitioner’s counsel sought permission to withdraw the application while reserving the right to file a fresh bail application after the charge-sheet is filed. The Court, after hearing the parties, granted the request to withdraw the application. No merits of the bail application were examined. The order disposes of the present application as withdrawn, leaving the petitioner free to approach the Court later with a fresh application.
Issues considered
- Whether the Court may permit the withdrawal of a regular bail application filed before the charge-sheet.
- Whether the petitioner can be granted liberty to file a fresh bail application after the charge-sheet is filed.
