Disposal
99-NOT PRESSED

Holding

The application was disposed of as not pressed, without consideration of its merits.

Summary

The High Court of Gujarat heard a regular bail application filed by Gautam Gigabhai Jod after the filing of a chargesheet. The applicant’s counsel informed the court that the forensic science laboratory (FSL) report and the video evidence on a pen drive were still pending, and consequently the applicant chose not to press the bail application. The court, noting the pending evidence, granted the applicant’s request to withdraw the application and directed the trial court to expedite the pending trial. No merits of the bail request were examined. The application was therefore disposed of as not pressed.

Issues considered

  • Whether the bail application can be withdrawn after being filed
  • Whether the trial court should be directed to expedite the trial pending the FSL report
