The Court allowed the withdrawal of the bail application and granted the petitioner liberty to file a fresh application after the charge‑sheet is filed.
Summary
The petitioner, Bhavin @ Pintu Vickrambhai Chavda, filed a regular bail application before the filing of a charge‑sheet. After hearing, the petitioner’s counsel sought permission to withdraw the application while reserving the right to file a fresh bail application before the Sessions Court after the charge‑sheet is filed. The Court considered whether such withdrawal could be permitted and whether the petitioner could be given liberty to re‑apply later. The Court held that the withdrawal was permissible and granted the requested liberty. No merits of the bail application were examined, and the matter was disposed of as withdrawn.
