The application for condonation of delay is allowed; the 460‑day delay is condoned.
Summary
The petitioner filed a criminal miscellaneous application seeking condonation of a 460‑day delay in filing an appeal against an acquittal order of the Additional Sessions Judge, Mehsana. The State of Gujarat, through the Additional Public Prosecutor, opposed the condonation. The court examined the explanation provided by the petitioner and determined that sufficient cause for the delay was established. Consequently, the court allowed the application and condoned the delay, permitting the appeal to proceed. No substantive merits of the original criminal case were addressed in this order.
Issues considered
- Whether a delay of 460 days in filing a criminal appeal can be condoned
- Whether the petitioner has shown sufficient cause for the delay
