The court allowed the withdrawal of the bail application and granted liberty to file a fresh application after the charge‑sheet.
Summary
The petitioner, Rahul, filed a regular bail application before the filing of a charge‑sheet in a criminal case against the State of Gujarat. The applicant’s counsel, after hearing, sought permission to withdraw the bail application while reserving the right to file a fresh bail petition before the Sessions Court after the charge‑sheet is filed. The learned Judge considered whether the court could permit such withdrawal and grant liberty to re‑apply later. The court granted the request, allowing the application to be withdrawn and permitting the petitioner to file a fresh bail application after the charge‑sheet. No merits of the bail application were examined, and the matter was disposed of as withdrawn.
Issues considered
- Whether a regular bail application filed before the charge‑sheet can be withdrawn at the applicant’s request
- Whether the court can grant liberty to file a fresh bail application after the charge‑sheet is filed
