The court held that the bail application may be withdrawn on the applicant’s request and the trial must be expedited.

Summary

Shahrukhkhan Yusufkhan Gori, an under‑trial prisoner, filed a regular bail application after the filing of a chargesheet. The applicant, through counsel, later sought permission to withdraw the bail application while requesting that the trial be expedited and reserving the right to file a fresh application if the trial did not progress substantially. The High Court, noting that it was not inclined to examine the merits of the bail petition, granted the request to withdraw the application. The Court directed the trial court to speed up the trial proceedings. No substantive merits of the bail claim were considered, and the applicant was left free to approach the Court again if necessary.

Issues considered

  • Whether a regular bail application filed after a chargesheet can be withdrawn at the applicant’s request.
  • Whether the trial court should be directed to expedite the trial of an under‑trial prisoner.
