Learned advocate for the applicant seeks permission to
withdraw the present application with liberty to file a fresh
application before the learned trial Court after recording of
evidence of eye-witnesses as directed by the Hon’ble Supreme
Court in the matter of co-accused.
Permission as prayed for is granted. Present application is
disposed of as withdrawn with above liberty. It is made clear that
merits of the case are not examined.
