1.     Rule returnable forthwith.               Learned APP waives

service of rule on behalf of the respondent State.



2.     The present application is               led by the applicant

seeking temporary bail for a period of 6 days on the

ground of marriage ceremony of his cousin sister which is

scheduled from 11.02.2026 to 16.02.2026.



3.     The applicant had preferred an application seeking

temporary bail before the Court of Principal District and

Sessions Judge, Morbi by way of            ling Criminal Misc.

Application No. 104 of 2026.             The competent court

allowed the said application and directed release of the

applicant for 6 days with police escort, cost of which to be

borne by the applicant.



4.     Learned advocate for the applicant submitted that,

the applicant instead of bearing the cost of police escort,

is ready to deposit security money.         Having considered

the ground mentioned in the application and considering

the facts and circumstance of the case, this court is

inclined to exercise discretion in favour of the applicant.



5.     Accordingly, the order dated 03.02.2026 passed by

the learned Principal District & Sessions Judge, Morbi in

Criminal Misc. Application No. 104 of 2026 is modi ed as

below:

       (I) The applicant is directed to be released on

       temporary bail for a period of 6 days, without police

       escort, upon his furnishing a security deposit of Rs.

             2,00,000/- (Rupees Two Lakhs only) before the jail

             authority, prior to his release. The said deposit shall

             be returned to the applicant when he surrenders

             within the stipulated time, without any further order

             from this Court.                      In case, the applicant fails to

             surrender within stipulated time, the amount of

             security deposit shall be forfeited by the jail

             authority.



             (III) The applicant shall mark his presence before

             the concerned police station every day and shall

             surrender to the jail authorities on expiry of the

             temporary bail period.



   6.        It is hereby clari ed that, no further extension shall

   be granted on expiry of the temporary bail period. The

   application is allowed in the aforesaid terms. Rule is

   made absolute. Direct service is permitted today.
