Holding
The application for restoration is allowed, the main matter is restored to its original file, and earlier interim relief is discontinued.
Summary
The petitioner filed a criminal miscellaneous application seeking restoration of the main criminal matter that had been previously removed from the court file. The High Court examined the application and noted a delay in filing the restoration request, which left the court uncertain about events during the intervening period. Consequently, the Court decided to discontinue any interim relief that had been previously granted. However, the Court allowed the restoration application, directing that the main matter be reinstated to its original file. The Court also reserved liberty for the petitioner to file a fresh application for interim relief if needed.
Issues considered
- Whether the delay in preferring a restoration application warrants discontinuance of previously granted interim relief
- Whether the main criminal matter should be restored to the original file despite the delay
