ORAL ORDER
1. The present application is filed for condonation of delay of
129 days caused in preferring Criminal Misc. Application
(restoration) application.
2. It is submitted that the delay has been caused on account
of genuine and bona fide reasons, and there is no culpable
negligence or laches on the part of the applicants. It is further
submitted that the applicants were in the process of procuring
the necessary documents, and due to this reason, the delay has
occurred. Hence, the delay be condoned and the present
application be allowed.

3. Considering the averments made in the application as well
as the law laid down in the decision of N. Balkrishnan Vs. M.
Krishnamurthy, reported in AIR 1998 SC 3222, present
application is allowed and delay of 129 days caused in preferring
restoration application is condoned. Rule is made absolute.
