                          ORAL ORDER

1.            Learned   advocate    Mr.     Dev     D.     Patel,      under
instructions, in his utter fairness submitted that the suit
proceedings has proceeded to the advanced stage and recording
of evidence is commenced in the suit.

2.            In the aforesaid circumstances, he submits that the
suit proceedings may be adjudicated as early as possible and
this Court may pass such direction with the further clarification
that all the contentions are kept open and Court should not be
influenced by any observation in the impugned order or disposal
of these revisions.

3.            All the submissions of learned advocate Mr. Dev D.
Patel, since found germane, are accepted and accordingly, both
the revisions are disposed of as not pressed.

  4.                 The learned trial Court is directed to decide the suit
  proceedings in both the matters, preferably within a period of
  One year outer limit from the date of receipt of this order,
  without being influenced by its own impugned order or disposal
  of these revisions.

  5.                 Needless to say that, all the contentions and rights of
  the parties are kept open.
