Holding
The appeal was dismissed because the compensation amount was below Rs.5 lakh, making it a petty claim that does not merit judicial consideration.
Summary
The Special Land Acquisition Officer appealed against a compensation award to the legal heirs of Mumtazbegum Khushalbava, alleging that the award should be reviewed. The compensation amount in dispute was less than Rs.5 lakh, which under a Gujarat Government Resolution dated 25‑10‑2016 is classified as a petty claim and is to be dealt with in Lok Adalat. The Court noted that the matter could not wait for a Lok Adalat and should be disposed of in regular hearing. After hearing counsel, the Court held that because the amount was below the Rs.5 lakh threshold, the appeal was not worthy of consideration. Consequently, the appeal was dismissed without addressing any substantive legal issues, and the compensation was ordered to be paid to the claimants after verification.
Issues considered
- Whether an appeal involving compensation less than Rs.5 lakh should be entertained by the High Court.
- Whether the matter should be withdrawn to Lok Adalat as per the State Government's policy for petty claims.

Having heard the submissions made at bar, the amount
involved in the subject matter of present First appeal is on
