1.    Rule returnable forthwith. Learned Assistant Government
Pleader Ms. Nidhi Vyas, as also Mr. Bhargav Pandya, learned
advocate, waives service of notice of Rule for and on behalf of the
respective respondents.

2.    Learned advocate Mr. Anvesh Vyas, would submit that one
opportunity may be given to the applicant – original petitioner and he
undertakes to conduct the matter as and when it is taken up for
hearing.

3.    Having heard learned advocates for the respective parties and
considering the averments made in the application as well as
assurance given by learned advocate for the applicant, the present

application deserves to be allowed, which is hereby allowed in terms
of paragraph – 9(B) of the application. Rule is made absolute to the
aforesaid extent. Consequently, Special Civil Application No.4177 of
