The Court granted permission to withdraw the petition and ordered it disposed, without addressing the merits.
Summary
The Equestrian Association of Gujarat filed a Special Civil Application before the Gujarat High Court seeking permission to withdraw its present petition and to file fresh writ petitions before the Delhi High Court, where related writ petitions were already pending. The petitioner contended that the Delhi High Court had already decided the issues raised in those writ petitions. The Court examined the request, noted that the petitioner had not raised any substantive objections, and decided not to go into the merits of the matter. It granted the petitioner's request, allowing the present petition to be withdrawn. Consequently, the petition stands disposed as withdrawn, and the petitioner is free to institute fresh proceedings in the appropriate forum.
Issues considered
- Whether the Gujarat High Court can permit withdrawal of a petition and allow the petitioner to file fresh writ petitions in another High Court
