The petition is disposed of as infructuous, with no merits being examined.
Summary
The petitioner, Aditya Multispecialty Hospital, filed a special civil application seeking removal of its name from an exclusion list maintained by the insurer, ICICI Lombard General Insurance Company, so that it could provide cashless and reimbursement services to patients. During the pendency of the petition, the respondent’s counsel produced a document evidencing that the hospital’s name had indeed been removed from the exclusion list. The petitioner acknowledged this development and submitted that the relief sought was now moot. The court noted that the factual change rendered the petition infructuous and therefore unnecessary to adjudicate on the merits. Consequently, the court disposed of the petition without examining the substantive issues. The order expressly states that no merits were considered.
Issues considered
- Whether the petition seeking removal from the insurer’s exclusion list becomes infructuous due to the respondent’s removal of the hospital’s name from that list during the pendency of the suit.
