G.N.F.C. EMPLOYEES UNIONversusTHE DEPUTY COMMISSIONER OF LABOUR AND DEPUTY REGISTRAR OF TRADE UNION

Disposal
DISPOSED AS INFRUCTUOUS

Holding

The petition was dismissed as infructuous, and the Court did not entertain the merits of the jurisdictional challenge.

Summary

The G.N.F.C. Employees Union filed a special civil application under Articles 226 and 227 of the Constitution and Section 14‑A of the Trade Union Act, 1926, challenging three orders dated 18‑May‑2022, 28‑June‑2022 and 1‑Oct‑2022 issued by the Deputy Commissioner of Labour and Deputy Registrar of Trade Union, Vadodara. The petition sought a writ of mandamus to quash the orders, a declaration that the Deputy Commissioner lacked jurisdiction under Section 14‑A of the Indian Trade Unions (Gujarat Amendment) Act, 1961, and a stay of the orders pending trial. During the pendency of the petition, the disputed trade‑union election was conducted, leading the petitioner’s counsel to submit that the petition had become infructuous. The High Court accepted this submission, disposed of the petition as infructuous without examining the merits, and vacated any interim relief. No substantive ruling on jurisdiction or the validity of the orders was made.

Issues considered

  • The petition became infructuous due to the conduct of the election during the pendency of the suit.
