The Court ordered the registration authority to decide the petitioner’s representation and, if warranted, correct the birth date on the certificate within three months, after affording a hearing.
Summary
Archana filed a petition under Article 226 of the Constitution and the Birth and Death Registration Act seeking correction of her birth date, which was erroneously recorded as 28/03/1990 instead of 28/03/1989 during the merger of Ognaj Village into Ahmedabad Municipal Corporation. She alleged that the error arose from administrative mishandling during record computerisation and submitted supporting documents. The State of Gujarat and the concerned registration authority opposed the relief. The High Court examined the facts and held that the petition warranted partial relief, directing the registration authority to consider the petitioner’s representation and, if appropriate, amend the birth certificate within three months, after giving her a hearing. The order therefore allowed the petition in part and made the rule absolute to that extent.
Issues considered
- Whether the registration authority erred in refusing to correct the date of birth on the birth certificate.
- Whether the petitioner is entitled to a writ of mandamus directing correction of the birth certificate under the Birth and Death Registration Act.
- Whether the High Court may direct the authority to decide the representation within a specified time.
