The Court directed the Gujarat Industrial Development Corporation to decide the pending representation within three months and disposed of the petition.
Summary
The petitioners, heirs of the late Govindbhai Kapuriya, filed a writ petition under Articles 14, 21 and 226 of the Constitution invoking the Gujarat Industrial Development Act, 1962, seeking mandamus to compel the Gujarat Industrial Development Corporation (GIDC) to decide a pending representation dated 17‑11‑2025 and to initiate forfeiture proceedings against M/s Moonshine Films Pvt. Ltd. for alleged breach of lease conditions on Plot No. 67, Gaviyar Industrial Estate. The petition also requested a site inspection and a declaration of breach. The respondent corporation contended that the representation would be decided in a reasonable time. The Court examined whether the corporation’s inaction warranted a writ of mandamus and held that the corporation must decide the representation within a fixed period. Accordingly, the Court directed GIDC to dispose of the representation within three months of receipt of the order and disposed of the writ petition.
Issues considered
- Whether the Gujarat Industrial Development Corporation is obligated to decide the petitioners' pending representation within a reasonable time.
- Whether a writ of mandamus is the appropriate remedy to compel the corporation to act.
- Whether the lease deed conditions have been breached by M/s Moonshine Films Pvt. Ltd., justifying forfeiture of the land.
