The High Court directed the Deputy Collector to decide the pending application under Section 5(3)(a) of the Gujarat Act within two months of receipt of the order.
Summary
Mitesh Bharatbai Mevada filed a Special Civil Application under Articles 14, 21 and 226 of the Constitution and Section 5(3)(a) of the Gujarat Prohibition of Transfer of Immovable Property and Provision for Protection of Tenants from Eviction from Premises in Disturbed Areas Act, 1991, seeking a writ of mandamus directing the Deputy Collector to decide his earlier application dated 24‑09‑2025 within two weeks. The earlier application had remained pending well beyond the statutory 60‑day limit. The respondent argued that the court could prescribe a time‑frame for disposal. The Court examined the record, noted the undue delay and the statutory requirement, and held that the Deputy Collector must decide the pending application promptly. Accordingly, the Court directed the Deputy Collector to decide the application within two months of receipt of the order, thereby disposing of the petition.
Issues considered
- Whether the Deputy Collector’s failure to decide the application filed on 24‑09‑2025 within the statutory 60‑day period violates the provisions of the Gujarat Act and the petitioner's constitutional rights under Articles 14, 21 and 226.
- Whether the High Court can issue a writ of mandamus directing the respondent to decide the pending application within a specified time.
