GANPATBHAI LAVJIBHAI PARMARversusSTATE OF GUJARAT

Disposal
56-DISPOSED AT ADMISSION STAGE

Holding

The court granted the habeas corpus relief, allowing the corpus to join her in‑laws and disposed of the petition as withdrawn.

Summary

Ganpatbhai Lavjibhai Parmar filed a special criminal application (habeas corpus) seeking the release of a detained woman (the corpus) from the custody of the State of Gujarat. The parents of respondent No.4, Natubhai Solanki and Laxmiben Solanki, appeared before the bench and expressed that the corpus wished to join her in‑laws, a request the in‑laws also accepted. The court allowed the corpus to go with her in‑laws and directed the Sakhi One Stop Center to complete the formalities. The counsel for respondent No.4 was instructed to file a vakalatnama, and the petitioner’s counsel chose not to press the writ further. Consequently, the petition was disposed of as withdrawn without any order as to costs.

Issues considered

  • Whether the detention of the corpus was unlawful and warranted relief under a habeas corpus petition.
  • Whether the corpus could be released to join her in‑laws in accordance with her expressed desire.
