SURAJSINH VINODSINH BIHOLAversusSTATE OF GUJARAT

Disposal
35-ANY OTHER MODE @ ADM.STAGE

Holding

The Court held that the police must register the petitioner's complaint and decide on it within eight weeks.

Summary

The petitioner, Surajsinh Vinodsin Bihola, filed a special criminal application seeking a direction for the police to register his complaint, alleging that while the opposite party's FIR was recorded, his own complaint lodged on 18 September 2025 at Pethapur Police Station remained unregistered. The petitioner claimed injuries resulted from a scuffle between the parties and that the police had taken no action on his complaint. The respondent, the Jail Superintendent and others, contested the petition. The Court examined whether the police were obligated to register the complaint and, if so, directed them to decide on it within eight weeks. Consequently, the Court ordered the police to take appropriate action on the petitioner's complaint within the stipulated period and disposed of the petition.
