High Court of Gujarat

VIJAYJI S/OF POPATJI SHANTIJI THAKORversusSTATE OF GUJARAT

Disposal
58-RULE ISSUED & RULE ABSOLUTE/ALLOWED @FH

Holding

The Court partially allowed the application, granting parole for ten days with a personal bond and sureties, subject to strict conditions and no possibility of extension.

Summary

The petitioner, Vijayji, applied to the Gujarat High Court for an extension of parole leave, contending that he had been granted temporary bail in a separate criminal appeal but had not availed it due to another pending offence. The State opposed the application. The Court examined the applicant's request and the surrounding circumstances, and exercised its discretion in favour of the petitioner. It ordered that the petitioner be released on parole for ten days, subject to a personal bond of Rs.25,000 and two sureties of Rs.25,000 each, and daily reporting to the concerned police station. The Court further stipulated that the petitioner must not enter the Santej Police Station area except for reporting, and that no extension or reduction of the bond would be entertained. The rule was made absolute, thereby partially allowing the application.
