Decided

BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

The petitioner, Abhay Kumar, was arrested on 31 December 2025 in connection with the recovery of 432 litres of liquor from a Bolero vehicle, alleged to be a violation of Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was neither the owner nor the driver of the vehicle and that no incriminating material was found in his possession, asserting his innocence. The prosecution opposed bail, while the petitioner’s counsel highlighted the lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and the petitioner’s limited custodial period despite a prior criminal antecedent. The court considered the facts, the duration of custody, and the statutory requirements, and decided to grant bail. Bail was ordered on a bond of Rs. 15,000 with two sureties, subject to conditions regarding surety, appearance, and non‑interference with evidence or witnesses.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the procedural requirements of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, have been complied with.
  • Whether the petitioner’s prior criminal antecedent and period of custody justify denial of bail.
