Decided

BAIL REJECTED

Holding

Anticipatory bail was refused.

Summary

Ugan Poddar applied for anticipatory bail after being implicated in a case (PS Dhamdaha Case No. 201 of 2025) for assaulting Manoranjan Poddar with a lathi, causing two injuries, one grievous, under several sections of the Bharatiya Nyaya Sanhita. The petitioner claimed he was falsely implicated due to a land dispute and asserted his innocence. The State opposed the bail, highlighting the seriousness of the alleged offences and the petitioner’s prior criminal antecedent. The court examined the nature of the accusations, the injuries inflicted, and the statutory provisions governing anticipatory bail. Considering the gravity of the charges and the antecedent, the court refused the petitioner's anticipatory bail application.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the Bharatiya Nyaya Sanhita in view of the alleged assault and grievous injury.
  • Whether the existence of a prior criminal antecedent precludes the grant of anticipatory bail.
