BAIL GRANTED

Holding

The court granted bail to the petitioner subject to monetary and procedural conditions.

Summary

The petitioner, Anil Yadav, was arrested in connection with Excise P.S. Case No. 1304 of 2025 for alleged possession of 44 litres of illicit liquor, contravening Section 30(a) of the Bihar Prohibition and Excise Act. The prosecution alleged that the liquor was recovered from an open area behind the petitioner’s shop, while the petitioner claimed he was falsely implicated and no liquor was found in his possession. The petitioner, who has six prior criminal antecedents, sought bail, arguing non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed the bail application. After considering the facts, the court decided to grant bail, subject to a bond of Rs. 15,000 with two sureties and conditions regarding appearance, non‑tampering with evidence, and travel restrictions. The bail order was made pending framing of charge, if not already done.
