Patna High Court

AMIT YADAV @ AMIT KUMAR YADAVversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court held that bail could not be granted and dismissed the petition.

Summary

Amit Yadav was charged under several sections of the Indian Penal Code (147, 148, 149, 341, 323, 302, 506) and Section 27 of the Arms Act. He applied for regular bail, marking his fifth attempt to obtain it. The petitioner’s counsel argued for release, but the court noted that the matter had already been considered on its merits in the Sessions trial (No. 312 of 2023) and bail had been denied then. The High Court found no justification to overturn the earlier decision and was not inclined to grant bail. Consequently, the bail petition was rejected.

Issues considered

  • Whether bail should be granted to the petitioner in a case involving serious IPC offences and an Arms Act violation.
