Upendra YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to bond and surety conditions.

Summary

The petitioner, Upendra Yadav, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act after 150 litres of liquor were recovered from a bush. He claimed innocence, stating that no incriminating material was found in his possession and that his name surfaced only through local disclosures. The petitioner had been in custody since 23‑12‑2025 and possessed six prior criminal antecedents, though all were on bail, and another co‑accused had already been granted regular bail. The State opposed bail, but the court, noting the lack of direct evidence, the open nature of the recovery site, and the petitioner’s custody duration, decided to grant bail with a bond of Rs.15,000 and two sureties, subject to conditions regarding surety and appearance. The bail order was issued by Justice Rudra Prakash Mishra.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the bail application.
