Patna High Court

Alok Kumar PandeyversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was refused as the forged insurance policies implicated the petitioner.

Summary

Alok Kumar Pandey, owner of several buses operating under the name Alok Bus Service, faced an FIR (Case No. 459 of 2025) for alleged offences under Sections 318(4), 338, 336(3), 340(2) and 3(5) of the Bharatiya Nyaya Sanhita, based on forged insurance policies for three of his buses. The petitioner applied for anticipatory bail, asserting that he had no knowledge of the forgery and maintained a clean antecedent. The State, represented by the Additional Public Prosecutor, opposed the bail application, emphasizing the seriousness of the alleged forgery. The court examined the fact that the insurance policies were indeed forged and that the petitioner, as the owner, was implicated. Consequently, Justice Prabhat Kumar Singh refused the anticipatory bail, concluding that the circumstances did not merit granting relief.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the alleged forgery of insurance policies.
  • Whether the petitioner had knowledge or participation in the alleged forgery.
  • Whether the offences under the cited sections of the Bharatiya Nyaya Sanhita justify denial of anticipatory bail.
