The court held that anticipatory bail may be granted subject to the conditions prescribed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Summary
Petitioners Rakesh Kumar Mishra and Ashish Kumar Mishra sought anticipatory bail fearing arrest in a case (Motihari Town P.S. Case No.240 of 2025) filed under Sections 126(2), 115(2), 118(1), 351(3) and 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The prosecution alleged that the petitioners, following a school‑related dispute, threatened and later attacked a ninth‑standard student with a knife, causing injuries. The petitioners contended they were not present at the scene, were falsely implicated, and that the injury was minor; they also highlighted a clean antecedent for the younger petitioner. The State opposed the anticipatory bail. After considering the submissions, the court granted anticipatory bail, directing the petitioners to furnish bail bonds of Rs 10,000 each with two sureties, subject to the conditions of Section 482(2) of the B.N.S., 2023.
Issues considered
- Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 in view of the allegations under Sections 126(2), 115(2), 118(1), 351(3) and 3(5).
- Whether there is a prima facie case that the petitioners are likely to be arrested and may tamper with evidence or influence witnesses.
