Patna High Court

Dinbandhu SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that regular bail should be granted to the petitioner.

Summary

Dinbandhu Singh was arrested in connection with a case involving kidnapping and murder of several persons, alleged under Sections 140(1), 103(1), 238 and 61(2) of the Bharatiya Nyaya Sanhita. The prosecution alleged that the accused had abducted the victims and later the bodies were found on a railway track. The petitioner argued that he was not named in the FIR and that a co‑accused, Rakhi Devi, had already been granted regular bail in a similar case. The State opposed the bail, citing the seriousness of the offences. Considering the nature of the accusation, the period of custody and the precedent of bail to a similarly situated accused, the High Court allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences under the Bharatiya Nyaya Sanhita.
  • Whether the petitioner’s non‑mention in the FIR and the grant of bail to a co‑accused affect the decision on bail.

                   A.P.P. for the State.

                                2. Petitioner seeks regular bail in connection with

Punpun P. S. Case No. 279 of 2025 registered for the offences

                   punishable under Sections 140(1), 103(1), 238, 61(2) of the

                   Bharatiya Nyaya Sanhita.

                                3. The prosecution case, in brief, is that on

11.09.2025, Pramod Kumar made a call from mobile to the

informant and informed that Subodh Kumar @ Loha Yadav

(deceased), Dheeraj Kumar, Lovely Kumari (deceased) and

Sudhanshu Kumar had been picked up from Ram Krishna by all

the FIR-named accused along with some unknown persons, who

dragged them away. Later, the informant received information

from Dhanarua Police Station that two unidentified dead bodies

had been found on the railway track. The bodies were sent to

PMCH, where the informant identified them as her son Subodh

Kumar @ Loha and Lovely Kumari. The informant alleged that

both had been murdered and their bodies thrown on the railway

          track.

                       4. Learned counsel for the petitioner submits that

petitioner is not named in the F.I.R. One Dheeraj Kumar, who

was also kidnapped along with the deceased, has not named this

petitioner during the investigation. Similarly situated co-

accused, namely, Rakhi Devi has already been granted regular

bail by this Court vide order dated 19.11.2025 passed in Cr.

Misc. No. 77969 of 2025. Petitioner is in custody since

          14.09.2025.

                       5. However, learned A.P.P. for the State vehemently

          opposed the bail application.

                       6. Considering the nature of accusation, period of

custody and the fact that similarly situated person has already

been granted regular bail, this bail application is allowed. The

petitioner, above named, is directed to be released on bail on

furnishing bail bond of Rs. 10,000/- (Ten thousand) with two

sureties of the like amount each to the satisfaction of the learned
