Permission was granted to withdraw the Civil Revision and the petitioners were given liberty to file an appeal within thirty days, with any delay to be condoned under Section 14 of the Limitation Act, 1963.

Summary

The petitioners filed a Civil Revision (No.44 of 2022) before the Patna High Court seeking relief against the respondents. They later approached the Court requesting permission to withdraw the revision and instead file an appeal before the concerned District Judge within thirty days. The Court, after hearing counsel, granted the permission to withdraw the revision and allowed the petitioners a liberty to file the appeal within the stipulated period. It further directed that any delay in filing the appeal be condoned by the trial court under Section 14 of the Limitation Act, 1963. Consequently, the Civil Revision application was dismissed as withdrawn and the certified copy of the petition was ordered to be returned to the petitioners' counsel.

Issues considered

  • Whether the Court can grant permission to withdraw a Civil Revision application and allow filing of an appeal within a specified period.
  • Whether any delay in filing the subsequent appeal can be condoned under Section 14 of the Limitation Act, 1963.
