The High Court set aside the order refusing anticipatory bail and granted bail to the appellants subject to conditions under Section 438(2) of the Cr.P.C.
Summary
The appellants, Amit Kumar and Mohan Kumar, were charged under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and several IPC provisions for allegedly assaulting a construction worker and using caste-based abusive language at the informant's house on 12 March 2024. They filed an appeal under Section 14‑A(2) of the SC/ST Act seeking anticipatory bail after the Special Judge had refused it on 4 October 2024. The appellants argued that the FIR was lodged after a delay of more than five months and that the alleged incident occurred inside a private residence, thus not attracting the public nature required for an offence under the SC/ST Act. The Special Public Prosecutor opposed the bail. The Patna High Court, after considering the submissions, granted anticipatory bail subject to a bond of Rs.5,000 and two sureties, and set aside the lower court’s order refusing bail, thereby allowing the appeal.
Issues considered
- Whether anticipatory bail can be granted under Section 14‑A(2) of the SC/ST (Prevention of Atrocities) Act, 1989.
- Whether the delay in filing the FIR defeats the charge under the SC/ST Act.
- Whether the alleged conduct, occurring inside a private dwelling, constitutes an offence punishable under the SC/ST Act.
