The High Court set aside the order refusing anticipatory bail and granted anticipatory bail to the appellants.
Summary
The appellants, four Yadavs from Karwayan village, were charged under several sections of the BNS, 2023 and Sections 3(1)(r) and 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act for allegedly assaulting an informant at his house. The Special Judge refused anticipatory bail under Section 14‑A(2) of the SC/ST Act. The appellants contended they have clean records, the alleged assault was private, no injury report exists, and therefore Section 18 of the SC/ST Act does not apply. The State argued that notice had been given to the informant, who chose not to appear. The Patna High Court, after considering the submissions, set aside the lower court’s order and granted anticipatory bail subject to bail bonds and sureties, invoking its powers under Section 482(2) of the BNSS. Consequently, the appeal was allowed.
Issues considered
- Whether anticipatory bail should be granted under Section 14‑A(2) of the SC/ST Act when the alleged offence is a private assault with no injury evidence.
- Whether Section 18 of the SC/ST Act applies to a private incident occurring inside the complainant’s residence.
- Whether the refusal of anticipatory bail by the Special Judge was justified in view of the facts and procedural compliance.
