The High Court set aside the lower court’s order refusing bail and granted bail to the appellant.

Summary

The appellant, Rahul Kumar, appealed against the order of the Exclusive Special Judge that denied him bail in a case alleging he participated in a firing that killed the informant's son, with charges under the Bharatiya Nyaya Sanhita, the SC/ST Act and the Arms Act. The appellant contended that he was falsely implicated, that the charge sheet was vague, and that no specific allegation under the SC/ST Act was made against him. The prosecution opposed bail, emphasizing the seriousness of the offences. The High Court, noting the appellant's lack of prior criminal record, the prolonged custody since November 2024, and the fact that co‑accused had been granted bail in a similar case, found no justification to continue detention. Consequently, the Court set aside the lower court’s order and granted bail on condition of a bond and sureties. The appeal was therefore allowed.

Issues considered

  • Whether the appellant is entitled to bail despite charges under Sections 127, 103, 351, 3 of the Bharatiya Nyaya Sanhita, the SC/ST Act and the Arms Act.
  • Whether the charge sheet specifically implicates the appellant under the SC/ST Act.
  • Whether the appellant's custody period and lack of prior record justify granting bail.
