Patna High Court

Badasah Yadav @ Balshah YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Bail is not to be granted; the trial must be expedited and the appellant remains in custody.

Summary

Badasah Yadav was charged under Sections 302 and 34 of the Indian Penal Code and Section 3(2)(v) of the SC/ST (Prevention of Atrocities) Act for murder. He applied for bail, which was rejected by the Additional Sessions Judge and later by this Court, which allowed renewal only after nine months. The appellant has been in judicial custody since 28‑10‑2023 and contended that his detention was without reason. The trial is at an advanced stage – nine prosecution witnesses have been examined, prosecution evidence closed, and defence evidence pending, with the trial expected to conclude within two months. The Court found no fresh ground to grant bail, noting the seriousness of the offence and the appellant’s five prior criminal antecedents, and therefore again denied bail, directing the lower court to expedite the trial within one month and permitting a fresh bail application if the trial is not concluded.

Issues considered

  • Whether bail can be granted at an advanced stage of trial for offences under IPC 302/34 and the SC/ST Act.
  • Whether the appellant’s continued judicial custody without any fresh ground violates his right to liberty.
  • Whether the direction to expedite the trial within a month is appropriate and lawful.

a liberty to renew the prayer after nine months if the trial is not

          concluded.

                    4. In compliance of the order dated 27.06.2025, a report

dated 17.07.2025 with regard to the present stage of trial has

been received. From perusal of the aforesaid report, it appears

that altogether nine prosecution witnesses have been examined
