The High Court set aside the order refusing anticipatory bail and allowed the appeal, granting anticipatory bail subject to conditions.

Summary

The appellants, four brothers from Mahamdpur, were charged under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act for allegedly assaulting a man and his nephew and snatching a chain, with the complainant alleging caste-based abuse. They applied for anticipatory bail, but the Special Judge refused the prayer on 16‑04‑2025 and 29‑05‑2025. The appellants contended they have clean antecedents, the allegations are vague and omnibus, and they were falsely implicated, also noting that one of them had filed a related case. The State, represented by the Special Public Prosecutor, opposed the appeal. The Patna High Court, hearing the appeal under Section 14‑A(2) of the SC/ST Act, set aside the lower court’s order and granted anticipatory bail subject to a bail bond of Rs.5,000 and two sureties, invoking its inherent powers under Section 482(2) of the CrPC. The appeal was allowed.

Issues considered

  • Whether the refusal of anticipatory bail under the SC/ST Act is justified in view of the alleged vague and omnibus nature of the accusations.
  • Whether the High Court can exercise its inherent powers under Section 482(2) of the CrPC to grant anticipatory bail in a case involving offences under the SC/ST Act.
