The High Court set aside the refusal of anticipatory bail and granted bail to the appellants subject to conditions.

Summary

The appellants, Arti Devi and her brothers Uday and Vijai Sharma, were charged under several IPC sections and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act for allegedly assaulting the informant and misappropriating furniture. They applied for anticipatory bail, which was denied by the Special Judge. In the appeal, the appellants argued they have clean records, the FIR was lodged more than 29 days after the alleged incident, and the case was politically motivated as the informant’s husband had filed a complaint against a municipal mayor. The Special Public Prosecutor opposed bail. The Patna High Court, considering the delay, alleged false implication, and the appellants’ clean antecedent, granted anticipatory bail subject to standard conditions and set aside the lower court’s order, allowing the appeal.

Issues considered

  • Whether anticipatory bail should be granted to the accused under Section 438 CrPC/Section 482 B.N.S.S. in a case under the SC/ST Act.
  • Whether the delay of more than 29 days in filing the FIR and the claim of false implication justify granting bail.
  • Whether alleged political vendetta influences the bail decision.
