The appellate court set aside the refusal and allowed anticipatory bail to the appellant subject to prescribed conditions.
Summary
The appellant, Shashi Singh, was charged under several IPC offences (307, 379, 341, 323, 504, 143) and sections 3(1)(r)(s) and 2(v) of the SC/ST (Prevention of Atrocities) Act in connection with an alleged assault and robbery at the complainant's residence. He applied for anticipatory bail, which was denied by the Exclusive Special Judge, SC/ST (POA) Act, Begusarai. The appellant contended that he was falsely implicated, was not present at the scene, and that the FIR implicated multiple other accused. The Special Public Prosecutor opposed the bail. On appeal under Section 14‑A(2) of the SC/ST Act, the Patna High Court set aside the lower court’s order and granted anticipatory bail subject to a Rs.5,000 bond and two sureties, with conditions under Section 438(2) CrPC/Section 482(2) B.N.S.S.
Issues considered
- Whether the appellant is entitled to anticipatory bail under Section 438 CrPC in view of the allegations under the SC/ST (Prevention of Atrocities) Act and IPC.
- Whether the refusal of anticipatory bail by the Special Judge was justified given the appellant's claim of non‑presence and false implication.
