The High Court set aside the lower court’s refusal and granted anticipatory bail to the appellants.
Summary
Lalbabu Sahni and Bittu Sahni were charged under multiple IPC offences and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 in connection with a police scuffle. The trial court refused their prayer for anticipatory bail. They appealed under Section 14‑A(2) of the SC/ST Act, arguing they have clean antecedents, the informant (the police officer‑in‑charge) failed to appear, and the allegations were false, general and omnibus. The Special Public Prosecutor opposed the bail. The Patna High Court, noting the submissions and the principle of parity with a similar case where anticipatory bail was granted, ordered that the appellants be released on anticipatory bail upon furnishing bail bonds and sureties, subject to conditions under Sections 438(2) CrPC/482(2) B.N.S.S. The impugned order was set aside and the appeal was allowed.
Issues considered
- The applicability of Section 14‑A(2) of the SC/ST (Prevention of Atrocities) Act to grant anticipatory bail.
- Whether the allegations in the FIR constitute a false, general and omnibus charge justifying bail.
- Whether parity with a prior case where anticipatory bail was granted mandates similar relief.
