Patna High Court

Shubham Kumar @ Shubham Kumar SinghversusThe State of Bihar

Holding

The appeal is allowed and the order rejecting bail is set aside, granting anticipatory bail to the appellant subject to conditions.

Summary

The appellant, Shubham Kumar, was charged under several sections of the Indian Penal Code and Section 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 for allegedly assaulting and abusing the informant and his wife over a monetary dispute. The Additional District and Sessions Judge had rejected his bail application on 28‑08‑2025. The appellant appealed under Section 14A(2) of the SC/ST Act, contending that he has a clean antecedent, was falsely implicated, and that anticipatory bail had already been granted in a related appeal (Cr. Appeal No. 4090 of 2025). The State opposed the bail, arguing the seriousness of the offences. The Patna High Court, after hearing counsel, set aside the lower court’s order, allowed the appeal, and directed that the appellant be released on anticipatory bail upon furnishing a bail bond of Rs.5,000 with two sureties, subject to compliance with conditions prescribed by the Special Judge.

Issues considered

  • Whether the appellant is entitled to anticipatory bail under Section 14A(2) of the SC/ST (Prevention of Atrocities) Act, 1989 despite the lower court’s rejection.
  • Whether the allegations against the appellant constitute a specific charge of assault and abuse sufficient to deny bail.
  • Whether the appellant’s claim of false implication and clean antecedent warrants bail.
