Holding
The bail petition was dismissed as there were no fresh grounds, and the trial was ordered to be expedited.
Summary
The appellants, Sunil Kumar and Rama Shankar Kumar, were convicted under IPC sections 302, 120B, 201, 34 and SC/ST Act section 3(2)(v) and were denied bail by the Special Judge. They appealed to the Patna High Court, arguing that they had been in judicial custody for over two and a half years without justification. The State and the informant opposed the bail. The Court found no fresh ground to revisit the bail decision and noted that the trial was ongoing at an advanced stage. Consequently, the Court upheld the lower court's refusal of bail and directed the trial court to conclude the trial within one month, allowing a fresh bail application thereafter.
Issues considered
- Whether the appellants are entitled to bail despite prolonged pre‑trial detention
- Whether there are any fresh grounds to reconsider the earlier bail denial
- Whether the trial delay warrants a direction for expedited conclusion
