The appeal is allowed and the order rejecting bail is set aside, granting bail to the appellant subject to conditions.
Summary
The appellant, Raushan Kumar, appealed against the Special Judge's order rejecting his bail application in a case involving alleged obstruction of electrical work, brandishing firearms, and a murder allegedly instigated by him under Sections 103(1) & 3(5) of the Bharatiya Nyaya Sanhita, 2023, Section 27 of the Arms Act and Section 3(2)(va) of the SC/ST Act. The prosecution alleged that the appellant ordered the shooting of an informant's son, while the defence argued that he was merely an order‑giver and that no caste‑based insult was made, contending there was no material evidence against him and that he had no prior criminal record. The Special Public Prosecutor and the informant opposed bail. Considering the circumstances, the Patna High Court found the bail denial unwarranted, set aside the lower court's order, and granted bail with conditions. The court ordered the appellant to furnish a bail bond of Rs.15,000 with two sureties and to appear at every trial date, allowing cancellation upon default. The appeal was therefore allowed.
Issues considered
- Whether the appellant is entitled to bail despite charges under the Bharatiya Nyaya Sanhita, Arms Act and SC/ST Act.
- Whether the facts alleged constitute an offence under Section 3(2)(va) of the SC/ST Act.
- Whether the evidence on record is sufficient to justify denial of bail.
